Terms of Service

By installing, accessing, or using any application ("App") developed and published by Zynapse ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use our Apps.

Zynapse develops and maintains a suite of applications for the Shopify platform, including but not limited to: BundleNest, StockForge, FraudSentry, ChatIA, Translate, RefBoost, and Analyzer SEO. Each App provides specific functionality as described on its respective product page.

To use our Apps, you must have an active Shopify store and install the App through the Shopify App Store or authorized installation link. By installing an App, you authorize us to access and process certain store data as required for the App's functionality.

You are responsible for maintaining the security of your Shopify account and for all activities that occur under your account.

Pricing for each App is as listed on the Shopify App Store or as communicated through the App. All payments are processed through Shopify's billing system.

• Subscription fees are billed according to your selected plan.
• Free trial periods, if offered, are specified per App.
• We reserve the right to modify pricing with 30 days' notice.
• Refunds are subject to our refund policy and Shopify's terms.

You agree not to:

• Use our Apps for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble any App
• Interfere with or disrupt the integrity or performance of our Apps
• Attempt to gain unauthorized access to our systems or networks
• Use our Apps to transmit malicious code or harmful content
• Resell, sublicense, or redistribute our Apps without authorization

All Apps, including their code, design, features, documentation, and content, are the exclusive property of Zynapse and are protected by intellectual property laws. Your use of our Apps does not grant you any ownership rights.

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps solely for your business purposes in connection with your Shopify store.

Your use of our Apps is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using our Apps, you consent to the data practices described in our Privacy Policy.

We strive to maintain 99.9% uptime for our Apps, but we do not guarantee uninterrupted or error-free service. We reserve the right to:

• Perform maintenance with reasonable notice when possible
• Modify, suspend, or discontinue any App or feature
• Limit the availability of services to any person, geographic area, or jurisdiction

To the maximum extent permitted by applicable law, Zynapse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Errors or inaccuracies in App functionality
• Any actions taken based on AI-generated recommendations or analysis

Our total liability for any claim arising from or related to our Apps shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Our Apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Apps will meet your specific requirements, operate without interruption, be error-free, or that any defects will be corrected.

You agree to indemnify and hold harmless Zynapse, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of our Apps, violation of these Terms, or infringement of any third-party rights.

You may terminate your use of our Apps at any time by uninstalling them from your Shopify store. We may terminate or suspend your access to our Apps at any time, with or without cause, with or without notice.

Upon termination, your right to use the App will immediately cease, and we may delete your data in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of our Apps after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable local jurisdiction, without regard to conflict of law provisions.
